General terms and conditions for orders in the Georg Petzoldt Profishop

1 Counterparty and scope

Your contracting party is R.v.Klier Werkstoffprüftechnik e.K., proprietor Martin Ziegner, Hansaallee 190, 40547 Düsseldorf, Germany, business division Georg Petzoldt Profishop. You can contact us at shop@georg-petzoldt.de or +49 2331 78 87 20.

These terms apply to orders placed through our online shop. A consumer is a natural person acting predominantly outside their trade, business or profession. A business customer acts in the course of their trade, business or profession when entering into the contract. Any differing terms of a business customer apply only if we have expressly agreed to them.

2 Order and conclusion of contract

You can add items to your basket without obligation and change or remove items, variants and quantities before completing your order. At checkout, you can review your contact details, delivery address, shipping costs and payment method. You can correct input errors before submitting your order and cancel the process at any time.

By clicking the final button, which clearly indicates an obligation to pay, you make a binding offer. An automatic acknowledgement of receipt does not constitute acceptance. The contract is concluded when we expressly confirm acceptance of the order or dispatch the goods. The language of the contract is German.

3 Prices, shipping and delivery

All prices are in euros and include statutory VAT. Any unit prices shown refer to the stated unit of quantity.

Standard delivery within Germany costs €4.90. German standard delivery is free for orders with a goods value of €100.00 or more. The total costs and available delivery options are displayed before you place a binding order.

The delivery times shown for the item and during the ordering process apply. If items with different delivery times are dispatched together, the longest stated delivery time applies. Shipping and product-related restrictions are shown before purchase.

Shipping & payment

4 Payment and retention of title

You can choose from the payment methods offered for your order at checkout. For payment in advance by bank transfer, you will receive payment information during order processing; the goods will be dispatched once payment has been received. For PayPal or card payments, follow the instructions of the relevant payment provider. The goods remain our property until payment has been made in full.

5 Contract text and customer account

We store order details to perform the contract. You will receive your order information by email. You can save or print these terms using your browser’s print function. Your customer account shows the orders assigned to your account. You sign in using a one-time code sent by email.

6 Right of withdrawal

Consumers have the statutory right of withdrawal described in the separate withdrawal information. You will also find the model withdrawal form there. We do not grant business customers a contractual right of withdrawal.

7 Guarantee

Consumers have the statutory rights in respect of defects. For business customers, the warranty period for newly manufactured goods is one year from delivery. Statutory rights of recourse and claims arising from fraudulent concealment, an expressly assumed guarantee, injury to life, body or health, intent or gross negligence remain unaffected.

8 Liability

Our liability is unlimited in cases of intent and gross negligence, injury to life, body or health, fraudulent conduct and liability under the German Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damage typical of the contract. Essential obligations are those whose fulfilment makes proper performance of the contract possible and on whose observance you may regularly rely. In all other respects, liability for slight negligence is excluded.

9 Dispute settlement and final provisions

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If any provision of these terms is invalid, the remainder of the contract remains effective. The statutory provisions apply in place of the invalid provision.
